La tutela del menor víctima de la violencia de género : marco normativo procesal y penal

The Spanish legal system provides specific protection for victims of gender violence, the paper addresses the legal situation of minors who are dependent on women victims of this type of violence. It analyses their procedural situation and, in particular, the criminal remedies for their protection. In a particular way, the aggravating circumstance of committing the act in their presence and the penalties that affect parental authority are examined.

This work addresses the way in which Argentine Fat Activism has developed, in recent years, the demand for depathologization of fatness, taking elements from critical discourses on the health of fat people to frame them in a perspective typical of the Human Rights. First, the contemporary fat body is described in terms of stigma and discrimination, especially in the health field. This article republishes (after the Italian Supreme Court judgement n.166/2020 on the Foodora Italia case) the contribution to the exegesis of the case brought by art. 1 para­graph 2 of the d. lgs. n. 81 of 2015 (in the text before the 2019 reform) delivered by the author in the 2015's "Colloqui Giuridici sul Lavoro" (edited) by Antonio Vallebona for the "Massimario di Giurisprudenza del Lavoro". The study rejected the thesis that the job organ­ised by the client was an intermediate regulation between the employee and the self-employed ones. Indeed regarding the conditions for its application it showed the need for extensive reading. The conclusion was that the new discipline was (and is) an anti-fraudulent one. It led to a (relative) expansion of the area ofsubordination as a consequence of a reduction in the scope of coordinated self-employed work. A little more than four years after that article the Italian Supreme Court (with the judgement n.166/2020) on the Foodora Italia case addresses for the first time the issue of the hetero-organised work (by art. 1 paragraph 2 of the d. lgs. n. 81 of 2015). The Supreme Court fully adheres to the paper's thesis. So in terms of the "re­medial" function of the standardthe nature of the organisation's specific conditionand eventually reducing the legal frame for coordinated work. The fact that the procedural matter dealt with the riders was (then and now is) utterly irrelevant for the correct interpretation of such a new provision. Giving to riders of the employee status is not an effect of the peculiarit­ies of the work through digital platforms. It is a consequence of the remedial nature of such a case-law.

Eclecticismo, Écart y alteridad: Symphony V American, de Leonardo Balada, como paradigma compositivo

Eclecticism is a complex creative trend born as a consequence of both postmodernism and the heterodox treatment of cultural identity borders. This aesthetic path emerges as a compositional model of great communicative power in contemporary creation in the last two decades. Our essay addresses the Symphony V "American" (2003) by Leonardo Balada (1933) as a compositional paradigm. Through this article we demonstrate the importance of including popular sounds and re-signifying materials in the creative conception. A valid model of communication ahead of the challenges of globalization and mass media processes is therefore established hereby.

This article focuses on skilled migration flows from Southern Europe into Mexico. From semi-structured interviews with Spanish and Italian immigrants living in four Mexican cities of Mexico, it addresses both reasons for immigration and labour incorporation in Mexican labour markets. Specifically, it explores: i) the role of the economic crisis and the lack of good employment in the countries of origin as a key factor when deciding an international migration; ii) the employment opportunities offered in Mexican labour markets for the highly-skilled immigrants, and iii) the role played by the Mexican state and its current immigration law when channelling this group into the labour market
